NOTICE OF A HEARING ON PROPOSED RATES
Property owners, ratepayers and other interested parties in or served or to be served by the sewage works of the Town of Avilla, Indiana are hereby notified that an Ordinance establishing rates and charges for the electric works of the town, was introduced at a meeting of the Town Council held on July 16, 2025. At a meeting of the Town Council to be held at 6:00 p.m. on August 20, 2025, at Town Hall, 108 S Main St, Avilla, IN 46710, there will be a public hearing on the matter of the rates and charges and consideration of adoption of the Ordinance #1685-7-25 which provides as follows:

AN ORDINANCE AMENDING ORDINANCE NO. 1441-03-05 FIXING THE SCHEDLUE OF RATES AND CHARGES TO BE COLLECTED BY THE TOWN OF AVILLA, INDIANA, FROM THE OWNERS OF PROPERTY SERVED BY THE SEWAGE WORKS OF SAID TOWN, AND OTHER MATTERS CONNECTED THEREWITH.
WHEREAS, the Town of Avilla, Indiana (the “Town”), has heretofore constructed and has in operation sewage works for the purpose of collecting and disposing in a sanitary manner of sewage of the Town; and
WHEREAS the revenues of the existing sewage rates and charges established by Ordinance No. 1441-03-05, adopted March 19, 2014 as amended by Ordinance no. #1641-5-22, are insufficient to enable the Town to properly operate its sewage works plant and to make payment of and provisions for the expenses and debt service obligations of said sewage works, and the Town Council now finds that the rates and charges established by said Ordinance should be increased; now therefore,
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVILLA, INDIANA:
Section 1. That Section 1 of Ordinance No., 1441-03-05 adopted on March 19, 2014 be amended to read as follows: Section 1. For the use of the services rendered by the sewage works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate or building that is connected to the Town’s sanitary sewage system or otherwise discharges sanitary sewage, industrial waste, water, or other liquids, either directly or indirectly, into the sanitary sewage system of the Town of Avilla, which rates and charges are payable as hereinafter provided and shall be in an amount determinable as follows:
a) The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the same is measured by the water meter therein used, except as otherwise provided by Town ordinance. Water meters will be read once each month, and sewage service bills shall be rendered once each month (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined is as follows:

The minimum charge for sewage service where the user is a metered water consumer, shall be as follows:

b) This Ordinance shall be in effect from and after its passage and the rates and charges established herein shall be reflected on the first full billing cycle immediately following the passage of this Ordinance.
c) Non-residential unmetered users shall be charges a rate based upon estimated monthly usage to be determined by Town officials on an individual basis.
d) For services rendered to the Town of Avilla, Indiana, said Town shall be subject to the same rates and charges hereinafter provided, or to charges and rates established in harmony therewith.
