NOTICE OF A HEARING ON PROPOSED RATES
Property owners, ratepayers and other interested parties in or served or to be served by the sewage works of the Town of Avilla, Indiana are hereby notified that an Ordinance establishing rates and charges for the water works of the town, was introduced at a meeting of the Town Council held on July 16, 2025. At a meeting of the Town Council to be held at 6:00 p.m. on August 20, 2025, at Town Hall, 108 S Main St, Avilla, IN 46710, there will be a public hearing on the matter of the rates and charges and consideration of adoption of the Ordinance #1684-7-25 which provides as follows:
ORDINANCE NO. 1684-7-25
AN ORDINANCE AMENDING ORDINANCE NO. 1642-5-22 AMENDING SCHEDULE 1 OF THE WATER RATE ORDINANCE TO INCREASE RATES BY THIRTY-FOUR PERCENT (34%) AND OTHER MATTERS CONNECTED THEREWITH.
WHEREAS, the Town of Avilla has previously adopted a water rate ordinance, Ordinance #1642-5-22, establishing water usage rates and charges set forth in Schedule 1; and
WHEREAS, the Town Council finds that a 34% increase in water utility charges is necessary to ensure the continued financial health and operational capacity of the municipal water utility; and
WHEREAS, the Town Council desires to amend Schedule 1 of the existing ordinance accordingly;
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVILLA, INDIANA:
SECTION 1: AMENDMENT TO SCHEDULE 1
Schedule 1 of the existing water rate ordinance is hereby amended and replaced with the following:

b) This Ordinance shall be in effect from and after its passage and the rates and charges established herein shall be reflected on the first full billing cycle immediately following the passage of this Ordinance.
SECTION 2: SEVERABILITY
If any section, clause, or provision of this ordinance is declared invalid, such decision shall not affect the remaining portions of this ordinance.
SECTION 3: EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its adoption and publication as required by law.
