NOTICE OF A HEARING ON PROPOSED RATES
Property owners, ratepayers and other interested parties in or served or to be served by the sewage works of the Town of Avilla, Indiana are hereby notified that an Ordinance establishing rates and charges for the electric works of the Town, was introduced at a meeting of the Town Council held on July 16, 2025. At a meeting of the Town Council to be held at 6:00 p.m. on August 20, 2025, at Town Hall, 108 S Main St, Avilla, IN 46710, there will be a public hearing on the matter of the rates and charges and consideration of adoption of the Ordinance #1686-7-25 which provides as follows:
ORDINANCE NO. 1686-7-25
AN ORDINANCE ESTABLISHING RATES AND CHARGES TO BE COLLECTED BY THE TOWN OF AVILLA, INDIANA, FROM THE CUSTOMERS SERVED BY THE MUNICIPAL ELECTRIC UTILITY OF SAID TOWN AND OTHER MATTERS CONNECTED HEREWITH
WHEREAS, the Town of Avilla, Indiana (“Town”) owns and operates a municipal electric utility for the purpose of providing and distributing electrical energy in the Town and surrounding areas; and
WHEREAS, the Town Council (“Council”) of the Town of Avilla has reviewed the administrative, operational, and fiscal needs of its electric utility including a Revised Rate Report prepared by Financial Solutions Group, Inc. which included a calculation of estimated increases in rates and charges based upon anticipated operating revenues and disbursements for maintenance and system operations and also included a recommendation that the new rates be phased in over a five-year period; and
WHEREAS, Council has reviewed the data, and reasonable projections based on that data, and now finds that it supports the increase of the existing monthly electric fees and charges and that such new rates and charges be phased in over a five-year period as doing so is a prudent and necessary step to ensure that electric rates remain sufficient to operate and maintain the Town’s electric works; and
WHEREAS, pursuant to Indiana Code 8-1.5-3-8(f), municipally owned electric utility’s rates and charges are subject to the approval of the municipal legislative body by ordinance after conducting a public hearing; and
NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Avilla, Indiana, in meeting duly assembled, and upon receipt of information deemed by it to be sufficient, including the rate report and after conducting an appropriately noticed public hearing,Ordinance No 1585-9-17, as amended by Ordinance 1643-5-22, is hereby amended to read as follows:
RESIDENTIAL SERVICE RATES.
The following shall be residential service rates for the Town of Avilla. The rate for electrical energy supplied hereunder shall be as follows:

BE IT FINALLY ORDAINED that all other provisions of other ordinances related to electric rates and charges not amended by this Ordinance shall remain in full force and effect and this Ordinance shall be effective from and after its passage in accordance with Indiana law. The rates and charges reflected herein will be effective beginning with the first full billing period after adoption and thereafter as described above.
